These Terms & Conditions (“Terms”) govern your access to and use of www.diagonalinsights.com (the “Website”), operated by Diagonal Insights & Strategy (“Diagonal”, “we”, “us” or “our”), a consumer research and strategy consultancy based in India. By accessing or using the Website you agree to these Terms. If you do not agree, please do not use the Website.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature.

/ 1. About the Website

The Website presents information about Diagonal — who we are, how we work, the sectors we cover and the kinds of research and strategy problems we help with — and provides ways to contact us. It is an informational site; nothing on it is an offer capable of acceptance, and browsing it does not create a client relationship with us.

/ 2. Enquiries and engagements

Submitting an enquiry through the Website, or contacting us by email, phone or WhatsApp, does not by itself create any engagement, obligation or contract. Any research or consulting services we provide are governed by a separate written proposal, statement of work or agreement negotiated between us — and if there is any conflict between such an agreement and these Terms, that agreement prevails for the services it covers.

Personal data you share when contacting us is handled as described in our Privacy Policy.

/ 3. Acceptable use

In using the Website, you agree that you will not:

  • violate any applicable law — including, if you access the Website from India, the Information Technology Act, 2000 and the rules made under it;
  • attempt to gain unauthorised access to the Website, its servers or any connected systems, or probe, scan or test their vulnerability;
  • introduce viruses, malware or any other harmful code, or interfere with the Website’s operation;
  • use the contact form to send spam, automated submissions or content that is unlawful, defamatory or infringes anyone’s rights;
  • scrape, harvest or systematically extract content or data from the Website without our written permission.

/ 4. Intellectual property

The Website and everything on it — text, design, graphics, logos, the Diagonal name and mark, and the arrangement of all of these — are owned by or licensed to Diagonal and protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable Indian and international intellectual property laws.

You may view, download and print pages from the Website for your own internal, non-commercial reference. You may not otherwise reproduce, republish, distribute or create derivative works from the Website’s content without our prior written consent.

/ 5. Third-party links and services

The Website contains links to third-party platforms — such as LinkedIn and WhatsApp — that we do not control. Following those links or contacting us through those platforms is subject to their own terms and privacy policies, and we are not responsible for their content or practices.

/ 6. Disclaimer

The Website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied — including as to accuracy, completeness, availability or fitness for a particular purpose. Content on the Website is general information about our practice; it is not research findings, professional advice or a recommendation for any specific situation, and you should not act on it as such.

To the maximum extent permitted by applicable law, Diagonal and its founder, employees and associates will not be liable for any indirect, incidental, special or consequential loss — including loss of profits, business, goodwill or data — arising out of or in connection with your use of, or inability to use, the Website. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Indian law, including liability for fraud.

You agree to indemnify and hold Diagonal harmless from claims, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Website.

/ 9. International access

We operate from India and make no representation that the Website’s content is appropriate or available for use in any particular jurisdiction. If you access the Website from outside India, you do so on your own initiative and are responsible for compliance with your local laws.

/ 10. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000. Subject to any mandatory consumer protections available to you in your own jurisdiction, the courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Website.

  • Changes — we may revise these Terms at any time by updating this page; the “Last updated” date reflects the current version, and continued use of the Website after changes are posted constitutes acceptance.
  • Severability — if any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver — our not enforcing any provision is not a waiver of our right to enforce it later.
